These Terms of Use govern your use of Noted Note, an iPhone notes app provided by Jerry Munyoka Nkongolo. By downloading or using Noted Note, you agree to these terms and Apple’s Standard Licensed Application End User License Agreement.

Use of the app

Noted Note is for personal note-taking, drawing, importing images, and organization. No account or sign-in is required. You may use the app only in compliance with applicable law and must not attempt to disrupt, reverse engineer, or misuse the app or its services except where applicable law expressly permits it.

Your content

You retain ownership of the notes, drawings, imported images, and other content you create. You are responsible for that content and for maintaining any backups you require. We do not claim ownership of your content.

Optional iCloud sync

If you enable iCloud sync, Apple stores your notes, drawings, and imported images in your private iCloud database using CloudKit. Availability and operation of iCloud are governed by Apple’s terms. Noted Note can also be used with local storage only.

Purchases

Noted Note offers one optional non-consumable in-app purchase through Apple’s StoreKit system. Payment is charged by Apple. Purchases may be restored using Restore Purchases where supported. Family Sharing is not offered for this purchase. Except where required by law, billing and refunds are handled under Apple’s policies.

Intellectual property

Noted Note, its interface, artwork, branding, and original app materials are owned by Jerry Munyoka Nkongolo. These terms give you a personal, limited, non-exclusive, non-transferable license to use the app; they do not transfer ownership.

Availability and changes

The app is provided on an “as available” basis. Features may change, be suspended, or be discontinued. To the maximum extent permitted by law, the app is provided without warranties beyond those that cannot legally be excluded.

Limitation of liability

To the maximum extent permitted by law, the provider is not liable for indirect, incidental, special, or consequential losses arising from use of the app. Nothing in these terms limits rights or liability that cannot legally be limited.

Termination

You may stop using Noted Note at any time. Your right to use the app may end if you materially violate these terms. Provisions concerning ownership, disclaimers, and liability survive termination where applicable.
